Proc. 2022-34, 8-1-22]. For plan years beginning in 2023, the percentage of household income decreases to 9.12%. The household income percentage for plans beginning in 2022 was 9.61% (see PAYROLL CURRENTLY, Issue 9, Vol. 29). Household income and affordability The ACA’s employer mandate requires applicable large employers to offer minimum essential coverage that provides minimum value and is affordable to all of its full-time employees. Affordability is determined as a certain percentage of an employee’s household income. Using the adjusted percentage for 2023, if the required employee premium contribution does not exceed 9.12% of the employee’s household income, then the coverage is affordable under the ACA. Safe harbors Because employers do not necessarily know an employee’s actual household income, there are three safe harbors that may be used instead. The safe harbors are based on: An employee’s Form W-2 wages. If the employee’s required contribution for the lowest-cost employee-only coverage does not exceed the applicable percentage of his or her Form W-2 Box 1 wages, then the coverage is affordable. An employee’s rate of pay. If the cost to the employee for the lowest-cost employee-only coverage does not exceed the applicable percentage of his or her monthly salary (hourly rate multiplied by 130 for hourly employees), then the coverage is affordable.
